Weather Malta Terms of Use

Weather Malta (App) is a weather information site. Weather Malta provides its users with weather forecasts and correlation services (e.g. individual forecasts and alerts).

By downloading, installing, accessing or using the App (collectively referred to herein as "Use"), you agree to be bound by these Terms of Use (these "Terms"). If you do not agree with any provision of these Terms, please do not Use the App.

1. USE RESTRICTIONS

The App is provided for personal, non-commercial use only. You may not:

  • reproduce, modify, or distribute the App in whole or in part;
  • create derivative works based on the App;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
  • remove any copyright notices or other proprietary markings from the App;
  • Use the App for any unlawful, fraudulent, or unauthorized purpose.

2. PROPRIETARY RIGHTS

The App and all content, data, images, graphics, software, trademarks, logos, trade names, domain names, and service marks (collectively referred to herein as "Intellectual Property") contained in or associated with the App are the exclusive property of Weather Malta or its licensors. Your Use of the App does not grant you any right or license under any patent, copyright, trademark, trade secret, or other intellectual property right.

3. CONTENT AND DISCLAIMERS

The content and data provided through the App (collectively referred to herein as "Content") is for general information purposes only. We do not make any warranties, express or implied, with respect to the accuracy, timeliness, completeness, reliability, or suitability of the Content. You acknowledge that your Use of the App may be subject to factors beyond our control, including but not limited to: satellite coverage, weather data providers, and network connectivity.

4. LIMITATIONS OF LIABILITY

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

  • loss of use or revenue;
  • loss of business or data;
  • claims of third parties; or
  • any other incidental or consequential losses.

WE SHALL ALSO NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM:

  • system failures;
  • network downtime;
  • weather-related events;
  • or any other event beyond our control.

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Weather Malta, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or in connection with:

  • your breach of these Terms;
  • your Use of the App;
  • your failure to comply with applicable laws and regulations.

5.1 ACTIVITIES

The activities suggested by this app are for informational and recreational purposes only. While we strive to provide helpful and accurate recommendations based on the information you provide about your hobbies, health conditions, and weather forecasts, the app's suggestions are not professional medical, fitness, or health advice.

You acknowledge and agree that:

  • You are solely responsible for consulting with a qualified healthcare professional before engaging in any activity recommended by this app, especially if you have existing health conditions or concerns.
  • The app developers, affiliates, and partners do not guarantee the suitability, safety, or effectiveness of any suggested activity.
  • The app does not monitor your personal health or physical condition in real-time and cannot account for all individual factors or circumstances.
  • You understand the risks involved in physical or recreational activities and agree to assume full responsibility for your actions.
  • The app and its developers disclaim all liability for any injury, loss, or damages arising from your participation in any recommended activities.
  • By using this app, you accept these terms and agree to hold the developers harmless from any claims or damages related to your use of the app's recommendations.

5.2 ALERTS & FORECASTS

The weather alerts and forecasts provided by this app are sourced from third-party weather services and are intended for general informational purposes only. While we endeavor to provide timely and accurate weather information, we do not guarantee the completeness, reliability, or accuracy of the alerts.

You acknowledge and agree that:

  • Weather conditions can change rapidly and unpredictably; therefore, the app's weather alerts may not reflect current or future conditions.
  • You are responsible for exercising your own judgment and taking appropriate precautions based on real-time conditions and official weather warnings from authorized government agencies.
  • The app developers, affiliates, and partners disclaim any liability for damages, losses, or injuries resulting from reliance on the weather information and alerts provided by this app.
  • The app is not a substitute for official weather services, emergency alerts, or professional advice in hazardous weather situations.

By using these features, you accept these terms and agree to use the information at your own risk.

5.3 BEACHES, MARINE

The swimming location recommendations and forecast information provided by this application are intended solely for informational purposes and do not constitute professional advice or a guarantee of safety. The forecasts and assessments are derived from various data sources, including but not limited to environmental, weather, and user-generated inputs, which may be subject to inaccuracies or omissions.

By accessing or utilizing these features, you expressly acknowledge and agree to the following terms and conditions:

The developers, licensors, and affiliates of this application (collectively herein referred to as the “App Providers”) make no warranties, express or implied, regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of the beach forecasts or swimming site recommendations.

The App Providers disclaim any and all liability for any personal injury, property damage, loss, or other adverse outcomes arising out of or in connection with your reliance on, or use of, the beach feature.

Beach and swimming conditions may change rapidly due to tides, currents, weather variations, water quality, and other factors beyond the control of the App Providers. It is your sole responsibility to verify current conditions with appropriate local authorities, lifeguards, or official sources prior to engaging in swimming or other water activities.

The feature and its contents do not substitute for professional advice, official warnings, or compliance with applicable safety laws and regulations.

You expressly assume all risks associated with swimming or water activities and agree to indemnify and hold harmless the App Providers from any claims, damages, or expenses arising therefrom.

By using the Beach Forecast functionality, you represent that you have read, understood, and accepted these terms in full and agree to abide thereby without exception.

5.4 FORECASTER & PREDICTOR GAME FEATURES

The App may offer certain game features (including but not limited to prediction games, forecast-based wagers, or any other betting-related activities) made available through third-party service providers.

Please note the following important disclaimers:

  • These features may be provided by third parties and are not controlled, operated, or endorsed by Weather Malta.
  • All legal, regulatory, and compliance obligations with respect to these game features are the sole responsibility of these third parties.
  • Your participation in any such game features is entirely at your own risk, and you are solely responsible for ensuring you comply with all applicable laws in your jurisdiction.
  • By using these features, you acknowledge and agree that Weather Malta has no responsibility or liability for your use of the game services.

5.4.1 Use of Third-Party Services

The App includes features provided by third-party companies that operate independently from Weather Malta. Weather Malta expressly disclaims any and all liability arising from the use of third-party services, including but not limited to any game, betting, or gambling features provided by such third parties. Your interaction with these third-party services is solely between you and the respective third party. Weather Malta shall not be responsible for any loss, damages, or disputes arising therefrom.

5.4.2 No Warranty for Third-Party Content

Weather Malta does not endorse or guarantee the accuracy, legality, or reliability of services or content provided by third parties. You acknowledge and agree that use of any third-party features, including but not limited to gambling or game elements, is at your sole risk.

5.4.3 Compliance with laws

You are solely responsible for ensuring that your use of any gambling-related content complies with all applicable laws and regulations in your jurisdiction. Weather Malta does not authorize or encourage illegal gambling activity and disclaims any liability for unlawful uses of the App or its third-party features.

5.4.4 Limitation of Weather Malta's Role Clause

Weather Malta serves as a platform for weather-related information and does not operate, manage, or control any gambling or betting functionalities within the App. All such services are provided by independent third-party operators, and Weather Malta disclaims any responsibility or liability in connection with these offerings.

6. ACCOUNT OR PARTIAL INFORMATION DELETION REQUESTS

If you wish to request the deletion of your account and all associated data, please send an email to [email protected] in order to process your request. We will process your request in accordance with applicable data protection laws and remove your data promptly.

7. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Malta. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration, as further described below.

8. ARBITRATION

Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration before a single arbitrator in accordance with the laws of Malta. The arbitration shall be conducted in Malta and shall be governed by the laws of Malta. You agree to pay any fees associated with the arbitration, including but not limited to: filing fees, service fees, hearing fees, and arbitrator fees.

9. MODIFICATIONS

We reserve the right to modify or update these Terms at any time without notice. Your continued Use of the App after any modifications shall be deemed your acceptance of such changes. You should review these Terms regularly for updates.

11. APPLE TERMS OF SERVICE

You acknowledge that you are downloading and installing the App from the Apple Store (the "App Store") under the terms of the Apple Developer Program License Agreement ("Apple Terms"). You agree to be bound by the Apple Terms, which can be found in the App Store. In the event of any conflict between these Terms and the Apple Terms, the Apple Terms shall prevail.

12. GOOGLE TERMS OF SERVICE

You acknowledge that you are downloading and installing the App from the Google Play Store (the "Play Store") under the terms of the Google Play Developer Distribution Agreement ("Google Terms"). You agree to be bound by the Google Terms, which can be found in Play Store. In the event of any conflict between these Terms and the Google Terms, the Google Terms shall prevail.

13. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Weather Malta regarding your Use of the App. They supersede all prior agreements, understandings, or representations, whether written or oral.

14. AMENDMENTS AND WAIVERS

No amendment to these Terms shall be binding unless in writing signed by both parties. No waiver of any provision hereof shall be deemed a continuing waiver and each breach shall constitute a separate and distinct breach.

15. NOTICE

You agree that we may provide you with electronic notice through the App or email, which shall be considered sufficient for all purposes. You acknowledge that your failure to receive or review such notices shall not be a defense to any claims arising under these Terms.

By downloading, installing, accessing or using the App, you have acknowledged and agreed to these Terms. If you do not agree with any provision of these Terms, please do not Use the App.
